Traffic infraction convictions can result in fines and points on your driving record. Paying the traffic ticket is the equivalent of pleading guilty or no contest to the offense. Misdemeanor traffic convictions may result in serious fines, up to one year in county jail, community service, and up to three years’ probation. Traffic violation felony convictions may result in time in state prison or county jail. Unless you successfully contest the traffic violation or successfully complete a court-approved "traffic school" (if you qualify for it), points accumulate against your driving record. The worse the violation, the more points accrue against your license. The California DMV only allows a fixed number of points to accrue before the driver is adjudicated a "Negligent Operator”. The DMV designation of a "Negligent Operator" means license suspension and additional driving restrictions. Points can also result in higher insurance premiums and may result in denial of insurance coverage altogether. 



The DMV maximum points allowable prior to a Negligent Operator designation is issued is as follows:
  • 4 or more points in a 12 month period
  • 6 points in a 24 month period
  • 8 points in a 36 month period.
